360 Arms (PTY) Ltd Associate Program Terms and Conditions
Please read these Associate Program Terms and Conditions carefully before joining our associate program. By signing up and participating in the associate program, you indicate your acceptance of these terms and your agreement to abide by them.
1. Program Overview:
Our associate program allows individuals and businesses (“Associate”) to earn commissions by promoting our products/services (“Products”) through unique associate links or codes. Associates will receive a commission for each sale made through their associate link or code, subject to the terms outlined herein.
2. Enrolment:
To become an Associate, you must complete the application process on our associate page found on our website www.360arms.co.za. We reserve the right to decline any application at our sole discretion.
3. Commissions:
3.1. Commissions are earned only on qualified sales made through your associate link or code.
3.2. The commission rate and structure will be outlined in your associate dashboard. Commissions are subject to change at any time, with reasonable notice provided to Associate.
3.3. Commissions are calculated based on the final purchase amount after any discounts, taxes, shipping costs, and returns have been applied.
3.4. Commissions will be paid out according to the payment schedule outlined in your associate dashboard.
4. Cookie Duration:
When a customer clicks on an associate link, a tracking cookie is placed on their device, allowing us to attribute the sale to the Associate. The default cookie duration is 30 days. If the customer makes a purchase within this time frame, the commission will be credited to the Associate.
5. Promotion and Marketing:
5.1. Associates are encouraged to promote our Products through ethical and transparent marketing methods.
5.2. Associates must not engage in any form of spamming, unethical advertising, or false claims about our Products.
5.3. Associates must clearly disclose their associate relationship and any potential benefits they receive when promoting our Products.
6. Prohibited Activities:
6.1. Associates must not engage in any activities that could damage our brand reputation.
6.2. Associates must not use their associate link for their own purchases to receive a commission.
6.3. Associates must not bid on our trademarked terms or variations thereof for paid search advertising campaigns.
6.4. Associates must not promote our Products on adult, gambling, or illegal websites.
7. Termination:
We reserve the right to terminate an associate’s participation in the program for any reason, including but not limited to violation of these terms, unethical behaviour, or fraudulent activity.
8. Intellectual Property:
8.1. Associates are granted a limited, non-exclusive, revocable, and non-transferable right to use our approved marketing materials solely for the purpose of promoting our Products.
8.2. Associates must not modify or alter our marketing materials without prior written consent.
9. Confidentiality:
Associates may have access to confidential information, including commission rates and performance metrics. Associates agree to keep this information confidential and not disclose it to any third parties.
10. Limitation of Liability:
We shall not be liable for any indirect, special, or consequential damages arising out of or in connection with the associate program.
11. Changes to Terms:
We reserve the right to modify these terms at any time without prior notice. Associates will be notified of any changes, and continued participation implies acceptance of the modified terms.
12. Governing Law:
These terms and the associate program shall be governed by and construed in accordance with the laws of South Africa and Namibia, without regard to its conflict of law principles.
